
AASP-IL to hold six-part webinar on legal rights and responsibilities of collision repair shops

Starting June 11, the Alliance of Automotive Service Providers of Illinois (AASP-IL) will hold a six-part webinar focused on teaching collision repairers their legal rights and responsibilities.
“This six-part seminar series is essential for anyone who needs a refresher or would needs a refresher or would like to learn about the laws that impact collision repairs in Illinois,” the release says. “It is designed to provide a cost-effective and convenient way to get an overview of current law with a focus on practical, day-to-day issues.”
AASP-IL member price for the webinar is $400, and the non-member price is $600. Register for the event here.
Each Wednesday seminar will include 50 minutes of instruction led by Patrick J. McGuire, an Illinois attorney with more than 20 years of experience advising and representing collision ships. Each seminar will include a 10-minute question-and-answer session.
All events will be held in Central Standard Time.

- Session 1, June 11 at noon: This session will focus on the Illinois Collision Repair Act that was enacted in 2004 and applies to repairs that cost more than $100. The AASP-IL event flier says the act can simplify a shop’s workflow and provide confidence when dealing with consumers and insurers. However, non-compliance can be costly.
- Session 2, June 25 at 5:30 p.m.: This session will focus on first-party claims. It will dive into policy provisions, statutes, and regulations that apply when a customer is making a claim for collision repairs under his or her own insurance, including issues related to deductibles, aftermarket parts, OEM procedures, paint caps, shop liability, diminished value, bad faith, and direct repair programs.
- Session 3, July 9 at noon: This session will focus on third-party claims. Subjects covered include the differences between first-party and third-party claims, policy provisions, statutes, and regulations that do not apply when a customer makes a claim against an at-fault party and his or her insurance policy. It will include issues related to deductibles, aftermarket parts, OEM procedures, paint caps, shop liability, diminished value, and direct repair programs.
- Session 4, July 16 at 5:30 p.m.: This session will focus on shop liability in the age of ADAS and OEM procedures. It will discuss shops’ options if a customer or insurance company says that they don’t want to pay for an OEM procedure, along with how a court determines whether a shop’s decision to perform or not perform a repair was negligent. The flier says a legally sound approach could decrease liability while increasing profits.
- Session 5, Aug. 6 at noon: This session will focus on what the rules are for total loss vehicles. It will discuss how shops can increase their chances of getting paid for labor, skill, materials, and storage charges and decrease their chances of getting stuck with a salvage vehicle.
- Session 6 August 13 at 5:30 p.m.: This session will focus on post-repair rights and remedies. It will discuss how Illinois law provides repairman with a variety of options for enforcing payment for their services and how each option has its pros and cons.
